Investigation

The Investigation section provides legal guidance on the investigation process as a whole, from collecting the evidence to approving a prosecution.

Good practice throughout the investigation process is vital both in the interests of justice and to reduce the likelihood that the outcome of the investigation (including any legal proceedings) can be successfully challenged. Policy and other important management decisions taken in the course of major investigations should be recorded in a key decision log.1

The process by which HSE carries out investigations is set out in its Operational Procedures.
