Investigative impropriety

1. Where there has been a serious abuse or misuse of power by the investigators, the court may decide that there has been an abuse of process. This is to protect the integrity of the criminal justice system. The judge/magistrates must decide whether the abuse of power is so serious that it amounts to an affront to public conscience. 1
