Ministerial decisions taken under the Great Britain Biocidal Products Regulation (GB BPR)

Overview

This page provides a list of ministerial decisions taken in Great Britain (GB) (England, Scotland and Wales) concerning active substance/product type combinations and biocidal products under the Great Britain Biocidal Products Regulation (GB BPR).

Under GB BPR, HSE as the acting competent authority (CA) provides the relevant ministers with an opinion or recommendation on a subject matter, for example an active substance approval, renewal or non-approval. On receipt and consideration of the opinion or recommendation of HSE, ministers will issue decisions. These decisions are termed ministerial decisions and are taken by the Secretary of State (SoS), or Scottish ministers, or Welsh ministers, as appropriate.

Some decisions are subject to consent requirements. These occur when the SoS must gain agreement from the devolved authorities before issuing a decision.

New GB active substance non-renewal decision

Biocidal products must be phased off the GB market

Following the applicant's withdrawal of support under the GB BPR, a decision has been taken not to renew the following active substance approval in GB:

Acrylaldehyde (Acrolein) (CAS 107-02-8 EC 203-453-4) in product type 12

As this active substance/product type combination is no longer supported for renewal, the previously postponed expiry date to allow the renewal to be carried out is no longer relevant. Therefore, the approval expiry date has changed from 28 February 2026 to 31 January 2024.

If you hold an affected GB BPR product authorisation or Control of Pesticides Regulations (COPR) product approval, we will contact you about cancelling or revoking your authorisation or approval. You will have an opportunity to submit comments or additional information and we will take account of these when finalising our decision.

Biocidal products containing these active substances in the relevant product types can no longer be supplied in GB after 15 August 2024 or used in GB after 15 February 2025

You must manage your stocks of the affected products to ensure they are removed from the GB supply chain by 15 August 2024.

New treated articles containing these active substances in the relevant product types cannot enter the supply chain or be imported into GB after 11 February 2024. Treated articles that have entered GB supply chains before this date can continue to be supplied and used.

For reasons beyond the control of the applicants, the approvals of the active substance/product type combinations listed below were likely to expire before a decision could be taken on their renewal under GB BPR.

To allow sufficient time for the renewal evaluation to be completed, a decision has been taken to postpone the expiry of the approvals until the following dates:

Postponement of approval expiry dates for renewals of 8 active substances

HSE has agreed a postponement of the approval expiry dates for eight active substances which were due to lapse within the next six months.

Under the GB Biocidal Products Regulation, where for reasons beyond the control of the applicant, the approval of the active substance is likely to expire before a decision has been taken on its renewal, the Secretary of State with the consent of Ministers in Scotland and Wales can issue a decision postponing the expiry date of approval for a period sufficient to enable the competent authority to examine the application.

Under these arrangements, the approval expiry dates for the following active substances have been postponed until 24 July 2023:

  • Propiconazole
  • Metofluthrin
  • Sulfuryl fluoride
  • Alphachloralose
  • Sulfuryl fluoride
  • Aluminium phosphide releasing phosphine
  • Boric acid
  • Disodium tetraborate pentahydrate

The GB List of Active Substances will be updated to reflect this decision and there are no further changes in the approvals.
