Notifying substances in articles

This information will be of interest to you if you are:

  • a company producing, importing and/or supplying articles in Great Britain, including purchasing, production and sales managers
  • An Only Representative of non-GB companies producing and exporting articles to GB.
  • Experts from industry associations and other stakeholder organisations informing companies about the requirements for substances in articles under UK REACH

Your duty under UK REACH

Importers and producers of articles must notify the Agency (HSE) if substances listed on the Candidate list (the list of substances of very high concern (SVHCs)) are present in their article(s), under certain conditions as laid out in article 7(2):

  1. the substance is present in those articles in quantities totalling over 1 tonne per producer or importer per year; and
  2. the substance is present in those articles above a concentration of 0.1 % w/w.

If you import several articles containing the same SVHC within them you need to consider the %w/w of the substance in each article and the total tonnage. For each article that contains the substance at 0.1% (w/w) or more, then the tonnage of the substance must be summed to identify any potential notification duty.

This requirement is identical to the equivalent provision under EU REACH.

What you must do

You must notify HSE no later than six months after the inclusion of the substance in the Candidate list.

The information you need to submit consists of:

  • the identity and contact details of your company
  • the identity of the substance and its registration number, if available
  • the tonnage range of the substance in the notified article(s)
  • a brief description of the use(s) of the substance in the article(s) and of the uses of the article(s)

The information is submitted through Comply with UK REACH using the relevant IUCLID template.

You should update your notification if the information previously notified has changed.
