Regulatory Update: 13/2015

Purpose

This Regulatory Update provides a summary of the consultation responses to the non-formal consultation on parallel trade products, HSE's response and revised new guidance.

Background

HSE consulted on proposals for parallel trade plant protection products in November 2013. The consultation closed on 16 January 2014.

Update

Since then HSE has explored the comments provided and worked on revising the guidance document to provide further clarification. The new guidance also takes account of the preliminary ruling of the fifth chamber of the Court of Justice of the European Union in the case of Mac GmbH v. Ministère de l’Agriculture, de L’Agroalimentaire et de la Forêt (C-108/13).

New guidance to be adopted

HSE will adopt the new guidance and procedures for applications for a new parallel trade permit received from 1st October 2015.
