Case 216 - Announcement at theatre stated "for health and safety reasons use of flash photography and video recording equipment is not permitted"


The enquirer was taken aback by the announcement before a theatre performance that "For Health and Safety reasons the use of flash photography and video recording equipment was not permitted".

Panel decision

Health and safety at work legislation does not require a ban on flash photography or video recording equipment. This appears to be more a case of the theatre protecting revenue from the selling of their own visual images, or stopping what is a nuisance to members of the audience and a distraction to the performers (or both). The theatre should be honest about the real reason rather than using the excuse "for health and safety reasons".
