Case 119 - Parent and child using shop toilet escorted for health and safety reasons


When a child was using a shop's toilet, the shop assistant insisted on waiting outside for health and safety reasons, claiming it was because the tap water was very hot.

Panel decision

It seems completely reasonable and correct for the assistant to inform the customer of the hot tap temperature issue and to be concerned. Accompanying them to the toilet and waiting outside is more likely to be to do with security concerns. It would have been better if the assistant had explained this rather than using the blanket "health and safety" excuse.
