Case 101 - Lady in electric wheelchair asked to leave post office on health and safety grounds

A lady in an electric wheelchair, who was queuing with her husband in the post office, was asked to leave as her electric wheelchair was blocking the aisle. The shopkeeper defended his decision to ban electric wheelchairs on health and safety grounds.

Panel decision

The shopkeeper does have a duty to consider the safety of its customers as well as staff, but banning a wheelchair on health and safety grounds seems a disproportionate response - although this is difficult to confirm either way on the basis of the information provided.
