Case 93 - Managers instructed all staff to wear hi-vis jackets no matter what work activity they are doing

Issue

A member of staff has complained that their managers have instructed all staff to wear hi-vis jackets, no matter what work activity they are doing.

Panel decision

There are no legal reasons for 'hi-vis' jackets to be worn at all times by all staff unless the risks in the workplace justify this. Implementing a blanket approach requiring staff to wear 'hi-vis' jackets at all times, in a predominantly low risk environment, does not seem a proportionate way to manage the risks. The employer should explain to their staff the real reasons why they are taking the approach of requiring blanket wearing of 'hi-vis' jackets.
