Case 76 - Funfair uses Health and Safety legislation to prevent skaters and skateboarders from riding skates and boards

Issue

The enquirer alleges that a funfair is using Health and Safety legislation to prevent skaters and skateboarders from riding their skates and boards in the funfair.

Panel decision

While there is no health and safety regulation banning skateboards or roller-skates in specific areas, it is considered proportionate and reasonable to ban these activities in crowed areas to protect both users and others. It would be helpful if the funfair management were clear about why they were banning these activities, rather than simply saying it is due to health and safety.
