Case 18 - Local authority refused to put cones in street to reserve parking space on the grounds of health and safety

Issue

The complainant asked her local authority parking services provider to put cones in the street to reserve a parking space for her removal van. This request was refused on the grounds of health and safety.

Panel decision

Deciding not to put cones in streets is unlikely to be justified on health and safety grounds. Local authorities are responsible for parking services and in this case it appears health and safety has been used as an excuse for an unpopular decision.
