As a health and safety professional Rob Slater ('Trust failed patients, Letters, 4 August) should not be outraged by the decision not to prosecute Maidstone and Tunbridge Wells NHS Trust.

Both the Health and Safety Executive and Kent Police made clear that their review of the information available led them to conclude that there was insufficient evidence to launch a criminal investigation. That being the case, there was no other sensible course of action for us.
