Foreword

This report is issued as part of the Health and Safety Executive's commitment to make information about inspection and regulatory activities relating to the above site available to the public. It is for distribution to members of the Berkeley Site, Site Stakeholder Group (SSG) and covers activities associated with the regulation of safety at Berkeley Site. These reports are distributed quarterly. Site Inspectors of HM Nuclear Installations Inspectorate (NII) normally attend SSG meetings and will respond to any questions raised there or subsequently by members of the SSG. Any other person wishing to inquire about matters covered by this report should contact the HSE Knowledge Centre on 0151 951 4382.

Summary

Berkeley Site was visited for routine inspections and meetings twice during this quarter. The visit was made on the following dates:

• 11th November 2008
• 18th to 19th November 2008

Routine matters

Compliance Inspections

Routine inspections are undertaken for the purpose of monitoring compliance with (i) the conditions attached by HSE to the nuclear site licences, and (ii) other relevant provisions of the Health and Safety at Work etc Act 1974, including the Ionising Radiations Regulations 1999.

There were no routine inspections this quarter.

Non-routine matters

NII observed the annual emergency demonstration exercise. This was found to be an adequate demonstration of the Berkeley emergency response arrangements.

Berkeley Site presented NII with a useful and clear annual review of safety.

• The site was clean and tidy and there were few comments following the walkdown.
• The major news items of the year were the deferment of all decommissioning in January 2008.
• The ROSPA award had been received for the fourth year running.
• Berkeley are working on a submission which proposes a significant reduction in staffing levels. The required number of SQEP staff will need to be retained. NII have 30 days after submission of the proposal to consider whether to intervene.
• NII expressed satisfaction with the new decommissioning arrangements. Safety cases need to be valid until the facility is decommissioned. NII agreement will be required before decommissioning milestones are varied.
• NII are working with the Magnox corporate centre to standardise the maintenance schedule arrangements at Berkeley and other sites.

Safety at nuclear sites other than nuclear and radiological safety and is now handled by HSE’s Field Operations Directorate who regulate conventional safety across UK industry, though the site inspector will continue to be the first point of call.

Regulatory activities

Licence Instruments

The Inspectorate has powers under the Nuclear Site Licence to issue Consents, Approvals and Directions. In addition, the Inspectorate uses Licence Instruments to issue Specifications and Agreements under the conditions attached to the Licence. No Instruments were issued this quarter.
