FOREWORD

This report is issued as part of the Health and Safety Executive's commitment to make information about inspection and regulatory activities relating to the above site available to the public. It is for distribution to members of the Berkeley Power Station and Centre Local Community Liaison Committee, LCLC, and covers activities associated with the regulation of safety at Berkeley Power Station and Centre. These reports are distributed quarterly. Site Inspectors of HM Nuclear Installations Inspectorate attend LCLC meetings and will be happy to respond to questions raised there by members of the LCLC. ROUTINE MATTERS

Inspection of the Berkeley site has continued during the quarter. Compliance inspection has dealt mostly with matters associated with re-licensing referred to below. Routine interaction included discussions on progress of decommissioning activities.

Following assessment of the Licensee’s proposal, a Licence Instrument was issued agreeing to the temporary suspension of the Berkeley Power Station operating rule no. 1 to allow installation of an improved fire suppression system in the Intermediate Level Waste vaults.

NON-ROUTINE MATTERS

Specialist inspectors continued interaction with the licensee concerning BNFL re-structuring. This is regulated by means of Licence Condition 36 Control of Organisational Change. A Licence Instrument agreeing to the final stage of the re-structuring was signed on 23 March. The re-licensing of Berkeley from BNFL to Magnox Electric Ltd. required by the re-structuring also consumed Inspector effort. The new licence was signed on 18 March to come into effect on 1 April 2005. Whilst a number of Legal Instruments were carried forward at re-licensing the terms of reference of the new Nuclear Safety Committee required Approval.

The licensee has reviewed its generic emergency arrangements for decommisioning sites and subsequently requested a change to the Approved Emergency Plan. NII observed a demonstration of the proposed Emergency Plan on 20 January and considered that it should adequately deal with any emergency on the site.

REGULATORY ACTIVITY

Legal Instruments

The Inspectorate has power under the Licence to issue Consents, Approvals and Directions. In addition the Inspectorate uses Licence Instruments to issue Specifications and Agreements under the conditions attached to the Licence.

The following Legal Instruments were issued in the period:

Site Licence No. 70

LI No. 500 Agreement under Licence Condition 23(6) to the Temporary Suspension of an Approved Operating Rule

LI No. 501 Approval under Licence Condition 11(3) of an alteration or amendment to part of the arrangements made by the licensee under Condition 11(1) of that Schedule for dealing with any accident or emergency arising on the site and their effects.

Site Licence No. 80

LI No. 500 Approval under Licence Condition 13(2) of the terms of reference of the Berkeley Nuclear Licensed Site Nuclear Safety Committee

LI No. 501 Specification under Licence Condition 13(9) that the licensee shall furnish to the Executive, within 14 days of a meeting of the Berkeley Nuclear Licensed Site Nuclear Safety Committee, copies of all documents considered, or advised on, by the Committee.
