FOREWORD

The report is issued as part of the Health and Safety Executive's commitment to make information about inspection and regulatory activities relating to the above site available to the public. It is for distribution to members of the Capenhurst District Liaison Committee and covers activities associated with the regulation of safety at Capenhurst. These reports are distributed quarterly. Site Inspectors of HMNuclear Installations Inspectorate normally attend DLCmeetings and will be happy to respond to questions raised there or subsequently by members of the DLC. 1. INSPECTIONS

Four site inspection visits were made to BNFL Capenhurst during this period on 17 April 2003, 22 April 2003, 30 April 2003 and 10 June 2003. NII's regulatory activities during this period were focused mainly on:

2. ROUTINE MATTERS

2.1 Compliance with Conditions Attached to the Nuclear Site Licence

2.2 Decommissioning Programme

During April, NII's regulatory assessment and inspection process was completed in respect of the Low Enriched Uranium (LEU) decommissioning activities in Building 300. Following consultation with the Environmental Agency a licence instrument was issued agreeing to the active commissioning of new facilities in B300 - In essence this gave NII's agreement for BNFL to start the task of moving and processing the radioactive legacy waste. Since the issue of the licence instrument NII has been monitoring operations in the B300 plant and has not identified any areas of significant concern.

Further discussions have been held with BNFL in order to allow the second (High Enriched Uranium - HEU) part of the decommissioning operation to proceed. BNFL have made NII aware of the content of the decommissioning safety care and a number of presentations and discussions have been held between NII and BNFL staff. No significant issues have been identified which might delay BNFL's continued decommission plans for the next phase of the project and currently BNFL are in the final stages of completing internal safety care processes. Discussions are continuing at a corporate level on the issue of worker classification under Ionising Radiation Regulations

2.3 Radiation Emergency Preparedness and Public Information Regulations 2001

2.4 Waste Disposal to Drigg

Nothing to report for this period.

2.5 Emergency Preparedness

A Level 1 Emergency Exercise Buzzard was held on 22 April 2003 to demonstrate the adequacy of site arrangements. This involved a simulated accident in one of the production plants requiring action from a number of site services. Cheshire Fire and Rescue also participated. The demonstration was witnessed by a team of fire inspectors from NII. We observed many features of good practice including new arrangements for the forward control point.

However, deficiencies in the roll call and mustering procedures caused concerns and at NII's request BNFL have agreed to arrange for a partial re-test of this part of the exercise to be completed by the end of July 2003.

REGULATORY ACTIVITIES

Licence Instrument No. 2 under Licence Condition 22 (1) was issued on 1 May 2003, agreeing to the active commissioning, operation and maintenance of the Building 300 LEU process plant and equipment.
