HSE PUBLIC REGISTER OF ENFORCEMENT NOTICES

This site gives details of enforcement notices issued by the Health & Safety Executive (HSE). 

This public register of prosecution/enforcement notices has recently been updated following a major change to HSE's IT system that supplies this data. We thank you for your patience whilst we have brought this register up to date.

Notices will appear on this database for a period of 5 years. Notices served on individuals under the age of 18 will be removed sooner. After 5 years, Notices served on companies are removed from the notice database and placed in the Notice History Database.

The Notice History Database is a new addition to HSE’s suite of enforcement databases, and has been launched to bring the publication of Notice records in line with our policy of Prosecution records.

HSE has taken steps to ensure that notices which are withdrawn or subject to Appeal are not included. To account for the appeals process and quality assurance, we allow 9 weeks to elapse after a notice is issued before adding it to this site. Where HSE is notified of an appeal outside this time period, the notice will be removed from the database.

HSE enforces health and safety legislation for some industry sectors in the UK - Excluding those enforced by Local Authorities. We cover factories, building sites, mines, farms, fairgrounds, quarries, chemical plants, offshore and nuclear installations, schools, hospitals and some other places where there is a work activity. You will not find notices on this site for Northern Ireland or the Republic of Ireland authorities.

Prior to 1 April 2006, HSE also enforced health and safety legislation for railways and you will find relevant notices on this site - however, the Office of Rail Regulation (ORR) became the health and safety regulator for the rail industry when responsibility was transferred from HSE and copies of Improvement and Prohibition notices issued by ORR since 1 April 2006 are available from their website ( http://www.rail-reg.gov.uk/server/show/nav.1283).

HSE inspectors normally enforce health and safety standards by giving advice on how to comply with the law. Sometimes we must order people to make improvements by issuing them with a notice, either an Improvement Notice which allows time for the recipient to comply or a Prohibition Notice which prohibits an activity until remedial action has been taken.

HSE issue notices to companies and individuals for breaches of health and safety law. The notice may involve one or more instances when the recipient has failed to comply with health and safety law - each one of these is called a "Breach".

If necessary, HSE may prosecute recipients for non-compliance with a notice (See Prosecutions Database). There are also circumstances when HSE will take No Further Action against non-compliance. Inspectors follow HSC’s enforcement policy to decide on the most appropriate action to take.
