The Notification of New Substances Regulations (NONS)

NONS has been replaced by REACH

As of June 1st 2008 NONS has been replaced by REACH and notifiers responsibilities under the NONS regulations are repealed [PDF 112KB].

The last date that the UK NONS CA will accept notification dossiers is the 31st of May 2008. If, after assessment, the dossier is found to be non-compliant a registration may then be made under REACH.

Substances that have been notified under NONS and have a recognised notification number will be transferred into REACH and will be regarded as already having been registered (at the relevant tonnage band). Each notification will be assigned a registration number by ECHA by Dec 1st 2008. You do not need to pre-register these substances.

When the next REACH tonnage threshold is reached the notifier/registrant will need to comply with the relevant requirements for that level under REACH [Article 24]. If a higher tonnage threshold is breached prior to May 31st you should inform us.

There are a number of transitional arrangements that notifiers should be aware of, for example how to claim their REACH registration number. This will be updated with any changes as they occur.

NONS is a European wide system that requires chemicals suppliers to get information on substances that are new to the European market. This information is used to decide whether or not the substance is dangerous. HSE together with the Environment Agency are responsible for running the scheme in Great Britain.

If you make chemicals and supply them to others within the EU or if you import chemicals then it is possible that these regulations apply to you. You may not even be aware that you are supplying a new substance as it may be contained within a product. For example, it could be the colorant in an ink-jet cartridge or part of a cleaning product. Remember that these regulations only apply to new chemicals.
