Guardian on construction fatality - HSE statement

The following statement is in response to the article 'Case study: construction worker killed on site but firm escaped prosecution' on page 24 in The Guardian, 29 April 2009:

HSE carefully examined the evidence gathered during the investigation into this incident, and the evidence given during the inquest into Anthony Lockey's death.

HSE and the Crown Prosecution Service agreed there was insufficient evidence to prosecute.

HSE has met with Anthony's family and explained why the decision not to prosecute was taken.
