Case 364 - Council no longer collecting verge litter

Issue

A newspaper columnist commented on huge amounts of litter on her route from a farm to the gallops, she says: " the council tell me they no longer collect verge litter due to health and safety regulations, it's a shocking reality those regulations don't stretch to protect our suffering British wildlife."

Panel opinion

Health and safety at work legislation does not prevent the council clearing road verge litter but they do need to ensure risks to workers from traffic are managed. There is already well-established Department for Transport guidance on this and HSE is working with industry to produce additional supporting guidance. The council shouldn’t use throw-away lines about health and safety but come clean about the real reason it doesn’t remove litter from its roads.
