Case 283 - Council blaming Health and Safety for stopping a centuries old market

Issue

A Council, has decided to relocate three market stalls from the centre of a busy road to a traffic free location. This decision has been reported in the press quoting ‘This is health and safety gone crazy’

Panel decision

The panel is clear that in this case the Council has taken a sensible and proportionate decision. In particular the decision to trial the new location for a year seems very sensible. This is not “health and safety gone mad” but a sensible response to the real risk of a market trader or a customer being seriously injured. It is a pity that the local press chose to report the story in this way when the evidence clearly points to a well thought out decision.
