Issue

Refusal by custodian of a housing estate to remove a refrigerator that had appeared to have been dumped on the estate.

Panel decision

There are no health and safety reasons why the fridge cannot be removed from the site provided the people engaged to do it follow simple and straightforward manual handling guidance. The panel is convinced that this case is a clear example of the estates manager using health and safety as an easy excuse to avoid the possible expense and hassle of organising for the fridge to be removed.
