Case 187 - Employer refuses to allow employees bottles of water on retail floor due to health and safety


An employer refuses to allow employees bottles of water whilst working on the retail floor. Health and Safety has been given as the reason. Until recently bottled water was allowed.

Panel decision

Provided the employer provides access to a suitable and adequate supply of drinking water for their employees, they are at liberty to ban employees from carrying bottles of water on the retail floor. They should not, however, cite "health and safety" as the reason when the motivation for the ban is something else.
