Residents complained that a housing association removed a wheelchair from the communal area of a sheltered housing complex because of health and safety. The residents said that different people used the wheelchair occasionally for a variety of reasons such as if someone was unwell or needed assistance carrying their shopping.
There is no health and safety regulation which would prevent a housing association from providing wheelchairs to residents.
The housing association does have to consider risks to users but it does not follow that withdrawing the wheelchair is reasonable. It would be better if the housing association consulted residents and staff to find a solution which allowed the tenants to have access to wheelchairs.
