A fish & chip shop had told a customer, he could not have 'batter scraps' for health and safety reasons.

Panel decision

There is no occupational health and safety law preventing a fish and chip shop from providing their customers with extra amounts of batter scraps. This appears to be another case of health and safety being used as a casual excuse. If the fish and chip shop owner has been directed not to sell the batter scraps then he should have stated this as the reason and not used health and safety.
