Issue

Complainant had been advised that he is not allowed to eat fruit and vegetables at his desk at work due to health and safety reasons. Throwing the cores/peels away in the rubbish bins by the desks is the main health and safety issue.

Panel decision

The employer may have a legitimate reason for prohibiting their employees from eating fruit at their desks, but they should be transparent about their reason and not pretend that health and safety legislation bans this practice.
