Case 20 - Shop sign says suppliers will not accept the return of dirty walking boots for health and safety reasons

Issue

A shop is displaying a sign to say their suppliers will not accept the return of walking boots that are dirty as the Health and Safety at Work Act prevents them from doing so.

Panel decision

There is nothing in the Health and Safety at Work Act to prevent boots being returned to a supplier, dirty or not. There may be other reasons why the boot supplier does not wish to accept the return of dirty boots but their use of the Health and Safety at Work Act is incorrect.
