New guidance

Revised HSE guidance on the Work-related Deaths Protocol

New operational guidance on the Work-related Deaths Protocol has been produced by HSE.

The Operational Circular OC165/9 applies to both the revised England and Wales Protocol (February 2003) and to the recently introduced Scottish Protocol (October 2006) and replaces the previous guidance OC 165/8.  Appendix 2 of the circular, which provides additional guidance on individual and corporate manslaughter, will be attached later to coincide with the implementation of the Corporate Manslaughter and Corporate Homicide Bill. 

The guidance also makes reference to an investigation handover document, which is currently on trial with the police and HSE.  The purpose of the document is to provide a formal record of when primacy for a joint investigation is passed from one authority to another.  A draft version of the handover document is available on the LACORS website.
