IMPROVEMENT/PROHIBITION NOTICE NO:
I carried out an investigation on the xxxx platform on xxxx 20xx accompanied by xxx, HM Inspector of Health and Safety. Our visit necessitated serving Improvement/Prohibition Notice No xxx. A copy of which is enclosed.
Improvement/Prohibition Notices are legal documents and you should read the notes on the back of the Notice with care. Failure to comply with a Notice is an offence which can lead to prosecution, where on summary conviction, a court can impose imprisonment for a term not exceeding 6 months in England and Wales and 12 months in Scotland or to a fine not exceeding £20,000, or both, or on conviction on indictment, to imprisonment for a term not exceeding 2 years, or a fine or both.
You may appeal against the Notice. Details of the appeal procedure are contained in the enclosed Booklet URN 10/518, which also contains form ETS19 that should be used for any appeal you may wish to make.
Your attention is drawn to HSE’s policy for making information on enforcement notices publicly available. If you think that this would disclose commercially confidential information, please give me written notification of this within 14 days.
A copy of this letter has been forwarded to the Safety Representatives on the platform, together with a copy of the Improvement/Prohibition Notice.
