Exemptions

7.1 Section 21 of the Act exempts authorities from providing information if it is ‘readily accessible’ elsewhere, including if a fee would have to be paid. For example codes of practice and guidance on regulations laid under the Health and Safety at Work Act 1974 are readily available at a cost from HSE Books. HSE is exempt from providing this information free of charge under FOI.

7.2 Section 22 of the Act exempts authorities from providing information if it is intended to publish it in the future. This includes instances where HSE plans to charge for this information.
