Outcome of Judicial Review Hearing

Dr Garry Fawcett MBE applied for permission to judicial review 10 "decisions" relating to a HSE Safety Alert regarding the 'Crazy Frog' fairground ride. Permission to challenge nine of these "decisions" was dismissed by His Honour Judge Beatson at a hearing in the High Court of Justice, Birmingham in July 2011. Permission was granted on one ground - to review the decision by HSE to advise ride controllers in a Safety Alert Action Notice (SAAN) that non destructive testing (NDT) should be carried out by an ADIPS registered inspector.

At the substantive hearing on 24 February 2012 at Nottingham County Court, His Honour Judge Beatson dismissed the Claimant's application for judicial review.
