An employee complained after discovering that a plant room of the council-run leisure centre where they had worked for many years contained asbestos. A survey several years before had identified asbestos containing materials. Information from the survey was not acted upon and no-one who worked in the plant room was made aware. As a result, work that was liable to disturb the asbestos was done without the necessary precautions in place required by law.
The Local Authority was successfully prosecuted, fined £18,000 and ordered to pay £7,722 costs.
