New Construction (Design and Management) Regulations - Timeline

1992 Temporary or Mobile Construction Sites (TMCS) Directive adopted  
1995 Construction (Design and Management) (CDM) Regulations 1994 (CDM 94) come into force To implement, in part, the TMCS Directive
1996 Construction (Health Safety and Welfare) Regulations 1996 come into force
2002 HSC publishes a discussion document Revitalising Health and Safety in Construction, To seek industry’s views on improving the construction industry’s then poor health and safety performance
2003 HSC agrees to revise the construction regulations. (The background and key objectives for the review are set out in Health and Safety Commission paper) To respond to industry’s comments on the Discussion Document.
2003 A Working Group (WG) of HSC’s Construction Industry Advisory Committee (CONIAC) - the CDM WG - is set up To develop detailed proposals and a consultation document (CD)
March 2005 HSC publishes consultation document To seek comments on revised CDM 94 and CHSW 96 regulations.
2005 - present HSE works with the CONIAC CDM Working Group
  • To refine the legislation in the light of views expressed
  • To continue informal consultation with key stakeholders
December 2005 HSC meets
January 2006 John Carpenter publishes report Developing guidelines for the selection of designers and contractors under the Construction (Design and Management) Regulations 1994  
January 2006 HSE engages two industry secondees:
  • Tim Kind (Senior Policy Adviser with the Forum for Private Business)
  • David Watson (a chartered engineer from the WSP Group).
  • To address concerns expressed in relation to some aspects of the proposed client and designer duties
  • To talk to client and designer stakeholders about the issues and how they could be addressed
  • To consider key messages for these groups to help them realise the benefits of the revised package

Report outputs "CDM Client role report" and "CDM Designer compliance report" were considered by HSE, CONIAC and its CDM Working Group.

March 2006

A CONIAC Working Group (the CDM Guidance WG) is set up, under the chairmanship of Kevin Fear (CITB-ConstructionSkills)

20 July 2005 CONIAC meets To discuss the draft CDM regulatory package:
August 2006 Subject to comments made at the 20 July meeting and subsequently, CONIAC agrees that the draft CDM regulatory package can be forwarded to HSC’s October 2006 meeting.

The HSC formally approved the draft package for formal proposal to Ministers.

 

7 February 2007
Lord McKenzie of Luton, as Minister with responsibility for health and safety, signs the CDM 2007 Regulations.  
8 February 2007 Ministerial consent given to the Approved Code of Practice (ACoP) which supports the Regulations.  
15 February 2007 The CDM 2007 Regulations are laid before Parliament and are expected to come into force as planned on 6 April 2007.
They are available on the Office of Public Sector Information website (See No 320.)
 
27 February 2007 CDM Regulations 2007: Approved Code of Practice L144, supporting the new CDM 2007 Regulations 2007, published, priced at £15.  
15 March 2007 Early Day Motion (EDM) tabled calling for a debate on the CDM 2007 Regulations.  
6 April 2007 CDM 2007 Regulations come into force.  
10 May 2007 EDM praying against CDM 2007 Regulations Parliamentary Debate takes place.
