Potential Impact of the Biocidal Products Directive (BPD) 2nd Review List

You should note that dossiers on Active Substances Notified under the Biocidal Products Directive (BPD) for product types 16 (molluscicides), 18 (insecticides, acaricides and products to control arthropods), 19 (repellents and attractants) and 21 (antifouling products) had to be submitted to the relevant EU Rapporteur Member State (RMS) by the 30 th April 2006. Some dossiers were not received by the deadline and these are listed on the Commission’s website . For those Active Substances for which no dossier was received then biocidal products containing these Active Substances will have to be removed from the EU market by the 31 st December 2007.

For those Active Substances for which a dossier was received, these are currently being checked for their completeness. If they pass the completeness check then the dossier will continue to the evaluation stage and products can remain on the market until the outcome of the review of the Active Substances is known. However, if the dossier on an Active Substances fails the completeness check then other companies or Member States have three months to inform the Commission whether they wish to take over the role of participant for the existing active substance/product type combinations concerned. Should no one take over this role then the 31 st December 2007 deadline still applies.

You should be aware that the UK is still currently working on the dossiers it has received and cannot give a definitive answer on the completeness of these Active Substances until at least October 2006. We are unaware of the progress of the completeness checks in other Member States and therefore cannot give you any definitive answer on the status of these Active Substances until the relevant RMS has notified us. We therefore suggest that you examine the European Commission’s website regularly and keep in contact with your Active Substances supplier. HSE will publish a list of all Active Substances in product types 16, 18, 19 and 21 that have passed the completeness check as soon as this has been agreed by the European Commission (hopefully by December this year). This information will be placed on our website .
