Transposition via the Biocidal Products (Amendment) Regulations 2007 of Directives amending the Biocidal Products Directive 98/8/EC

Regulation 3(d) of the Biocidal Products (Amendment) Regulations 2007 (SI 2007/293) inserts an ambulatory reference into the definition of the Biocidal Products Directive 98/8/EC (referred to as "the Directive") in regulation 2(1) of the Biocidal Products Regulations 2001 (SI 2001/880), such that the amendments to the Directive brought about by the Directives listed below are automatically implemented into UK law. The same effect is achieved in Northern Ireland by regulation 3(d) of the Biocidal Products (Amendment) Regulations (Northern Ireland) 2007 (SR 2007/190), which amends regulation 2(1) of the Biocidal Products Regulations (Northern Ireland) 2001 (SR 2001/422). The power to do this comes from section 28 of the Legislative and Regulatory Reform Act 2006 which inserts a new section 1A into the European Communities Act 1972.
