Responsibilities of Secretaries of State in relation to the work Of HSC/E

Relevant area of responsibility

Environment, transport and the regions

All matters concerned with HSE staffing and establishment. All aspects of HSC/E work which concern primarily the protection of workers and the public from the generality of hazards (except where other Secretaries of State have specific responsibility), including passenger. safety on railways and protection of public and workers from hazards connected with transport of dangerous goods by all modes of transport, including road, rail, air, inland waterways and through ports and harbours.

Administration and enforcement of the Employer's Liability (Compulsory Insurance) Act 1969.

Granting of licences under the Ammonium Nitrate Mixtures Exemption Order 1967.

Appointment of organisations to test, inspect and approve containers; and approval of examination schemes submitted by container owners in accordance with the International Convention for Safe Containers, as implemented by the Freight Containers (Safety Convention) Regulations 1984.

Gas safety and enforcement of Gas Safety (Rights of Entry) Regulations 1983.

Authorisation of persons to enforce Part III of Food and Environment Protection Act 1985 in relation to contraventions of the Control of Pesticides Regulations 1986 (and [from 1994] to enforce regulations to implement the Plant Protection Products Directive). Evaluation of applications for the approval of pesticides under the Food and Environment Protection Act 1985 (and [from 1994] evaluation of applications for approval of plant protection products).

Evaluation of applications for the approval of pesticides under the Food and Environment Protection Act 1985 (and [from 1994] evaluation of applications for approval of plant protection products). Licensing authority for veterinary medicines, including sheep dip.

Evaluation of applications for consent to release or market genetically modified organisms under Part VI of the Environmental Protection Act 1990.

Policy for planning controls under the Planning (Hazardous Substances) Act 1990.

SCOTLAND

Nuclear safety in Scotland.

Authorisation of persons to enforce Part III of Food and Environment Protection Act 1985 in relation to contraventions of the Control of Pesticides Regulations 1986 (and [from 1994] to enforce regulations to implement the Plant Protection Products Directive). Evaluation of applications for the approval of pesticides under the Food and Environment Protection Act 1985 (and [from1994] evaluation of applications for approval of plant protection products).

Evaluation of applications for consent to, release or market genetically modified organisms under Part VI of the Environmental Protection Act 1990.

Policy for planning controls under the Town and Country (Hazardous Substances) (Scotland) Regulations 1992.

Security of explosives.

WALES

Authorisation of persons to enforce Part III of Food and Environment Protection Act 1985 in relation to contraventions of the Control of Pesticides Regulations 1986 (and [from 1994] to enforce regulations to implement the Plant Protection Products Directive).

Evaluation of applications for the approval of pesticides under the Food and Environment Protection Act 1985 (and [from 1994] evaluation of applications for approval of plant protection products).

Evaluation of applications for consent to release or market genetically modified organisms under Part VI of the Environmental Protection Act 1990.

HEALTH

AGRICULTURE

Authorisation of persons to enforce Part III of FISHERIES & FOOD Environment Protection Act 1985 in relation to contraventions of the Control of Pesticides Regulations 1986 (and [from 1994] to enforce regulations to implement the Plant Protection Products Directive).

Evaluation of applications for the approval of pesticides under the Food and Environment Protection Act 1985 (and [from 1994] evaluation of applications for approval of plant protection products). Licensing authority for veterinary medicines, including sheep dip.

TRADE & INDUSTRY

Negotiation and implementation of EC "Single Market" Directives which deal substantially with the safety of products used at work (for example, Machinery Directive, Simple Pressure Vessels Directive).

Nuclear Safety in England and Wales. Management of nuclear safety research programmes.

Testing and assessment of flameproof apparatus constructed to the requirements of the US Code of Federal Regulations.

Management and operation of the well consent regime and for giving consents on behalf of the Secretary of State.

NOTE: Any Secretary of State may, having consulted the Secretary of State for the Environment, Transport and the Regions, direct or ask the Commission to do work on particular matters with respect to its functions. The Commission may also submit proposals for regulations or approved codes of practice to any Minister responsible for provisions which are relevant statutory provisions for the purposes of the HSWA.
