Background

The Machinery Directive (2006/42/EC) was implemented in the UK on 29 December 2009 by the Supply of Machinery (Safety) Regulations 2008, replacing in full the previous 1992 Regulations and the 1994 and 2005 amendments.

A further amendment to the Machinery Directive was published in the Official Journal of the EU on 25 November 2009 (Directive 2009/127/EC), bringing machinery for Pesticide Application into scope. The new provisions consist of minor amendments to Articles 2, 4, 9, and 11 of the Machinery Directive and additional essential health and safety requirements for machinery for pesticide application in Annex 1.

Main provisions

The Machinery Directive sets out the procedures that manufacturers must conform to with certain essential health and safety requirements (EHSRs). Machinery that conforms to all relevant requirements can then carry the CE mark, showing compliance with the EHSRs of the Machinery Directive and all other relevant Directives.

Developments

New UK amending regulations have been made to implement this amendment of the Machinery Directive (2006/42/EC) by the Department for Business, Innovation and Skills (BIS, previously BERR and DTI). The Supply of Machinery (Safety)(Amendment) Regulations 2011 come into force on 15 December 2011.
