Issue: Neither the Licensing Service nor its Inspectors have the authority to stop an activity session even if they believe it is dangerous if it continues. Only the enforcing authorities have this power. There are various ways of dealing with this situation.
- The Inspector should formally advise the instructor in charge that the activity should stop and that they will be putting in to a report that this advice was given.
- If applicable and or necessary the Inspector should contact the centre or instructor’s manager and repeat the advice.
- The Inspector or the licensing service office should contact the relevant Environmental Health Department or Health and Safety Executive local office and request that they attend the site as soon as possible with a view to serving a Prohibition Notice.
- Inspectors may even wish to consider writing the advice given on the Confirmation of Visit Sheet for signature by the provider.
