Prosecutions History
This site provides a prosecution history of convictions HSE has obtained against corporate bodies. All the cases on this site are over five years old. Details found here have previously been displayed for a period of five years on the main prosecutions database. The prosecutions history database is updated on a weekly basis. Details are recorded from 1 April 1999 onwards. Cases involving the prosecution of individuals will not appear on the prosecutions history database as they are subject to the Rehabilitation of Offenders Act 1974. Information about convictions obtained in the last 5 years can be found in the prosecutions database. HSE enforces health and safety legislation for most industry sectors in Great Britain - we cover factories, building sites, mines, farms, fairgrounds, quarries, railways, chemical plant, offshore and nuclear installations, schools, hospitals and other places where there is a work activity. You will not find cases on this site for Northern Ireland or the Republic of Ireland authorities. In deciding whether to bring a prosecution following a breach of health and safety law, inspectors follow HSC's Enforcement Policy Statement. HSE prosecutes both companies and individuals for breaches of health and safety law. When we prosecute someone, we prepare a "Case" against them. The case may involve one or more instances when the defendant has failed to comply with health and safety law - each one of these is called a "Breach". Sentences imposed by the courts take into account a wide range of factors unique to the circumstances and context of the particular case and defendant, and there are no standard "tariffs" for health and safety offences.
