Issue: When is Grade 1 water potentially licensable?

1. The Guidance from the Licensing Authority (L77) states that Grade 1 Water is normally exempt from licensing. 

2. However, the top end of the grade may still be licensable.

3. The following examples illustrate situations where it may be licensable:

  • If the instructor cannot paddle back up stream it is licensable (applies particularly to shallows and above weirs);
  • If the instructor cannot easily walk or wade across shallows because of the flow of water (to solve a problem, for example) then it is licensable.
N.B. neither of these examples works in reverse, e.g. just because the instructor can paddle upstream does not mean it is not licensable.
