Issue: The Adventure Activities Licensing Regulations 2004, regulation 2, requires that "some element of instruction or leadership" must exist for an activity to be licensable.
- The Guidance from the Licensing Authority on the Adventure Activities Licensing Regulations 2004 (L77), Appendix 1, paragraph 4 excludes from the requirement to hold a licence, "instruction given solely in connection with the supply of equipment" - this exclusion would include the hiring out of equipment.
- However, if the session is subsequently supervised (either from the land or from the water) and assistance provided to recover from or to avoid difficulties or dangers, then this is may be considered to be some element of instruction or leadership.
- This is consistent with the land based example of 'unaccompanied expeditions' where the supervisors are deemed to be providing leadership, albeit from a distance for some or all of the time.
- A typical example of leadership from a distance would be a beach operation where equipment was only available for use during certain periods, within a specified area and when supervision was being provided (typically from a rescue boat). This we believe is a licensable situation.
