Sub-contracted activities

Issue: Where a licensable activity is offered by a provider but not actually delivered by them, this situation should be recorded on the inspection report.

  1. For example, a provider sub-contracts a riding centre to provide licensable pony trekking.  The provider’s report should state "Pony Trekking: subcontracted."
  2. During the inspection, it should be made clear to the provider that they still retain certain legal responsibilities including those under the Health and Safety at Work etc. Act 1974, section 3 for the sessions.  In particular, these responsibilities include, inter alia, the requirement to check that the sub-contractor has a current and appropriate licence, where applicable.
  3. Pony trekking would appear on the riding centre’s licence but not on the provider’s licence.
